"If such notice is not so filed the contracting or doing of business shall be a fraud on the part of the person, firm, or corporation doing such business, and such person, firm, or corporation, as well as his or her or its agents, servants, or employees, may be prosecuted for such fraud, and his or her or its right to do business under a fictitious name may be taken away."
